Terms and Conditions of Use

General terms and conditions of CommerzCrediet GmbH governing the access to this digital platform and the provision of loan brokerage services.

Last updated: 14.10.2026

1. Scope and Subject Matter

These General Terms and Conditions govern access to the commerzcrediet.de platform as well as all brokerage enquiries initiated through it.

The service provided by CommerzCrediet consists in independent and non-binding brokerage of credit agreements (personal loans, mortgages, auto financing, debt consolidation, renovation and business credit) between borrowers and verified lending institutions.

2. Brokerage Status & Independence

CommerzCrediet operates as an independent credit intermediary (§ 34c GewO) and real estate loan broker (§ 34i GewO) and is not a bank. Credit agreements are concluded exclusively and directly between the borrower and the respective lending bank.

A loan brokerage agreement with consumers requires text form under § 655b of the German Civil Code (BGB) and is provided to the applicant prior to contract conclusion.

3. No Upfront Fees for Borrowers & Commission Disclosure

  • Access to our digital comparison tools and personal advisory services is completely free of charge for borrowers.
  • CommerzCrediet never charges advance fees, processing charges or out-of-pocket expenses to consumers.
  • Upon successful loan origination, CommerzCrediet receives a commission directly from the lending institution. The nature and calculation basis of this compensation are fully disclosed to the applicant under § 655a BGB prior to signing.

4. Duties of Diligence and Truthfulness

The applicant undertakes to provide accurate, truthful and complete information regarding income, employment, existing liabilities and personal circumstances.

Inaccurate or misleading disclosures may result in immediate loan rejection and may constitute a criminal offence under § 265b of the German Criminal Code (credit fraud).

5. No Guarantee of Approval & Banking Discretion

The decision regarding credit approval and final conditions rests solely with the respective lending bank based on its internal underwriting guidelines and credit assessment.

CommerzCrediet does not guarantee loan approval or specific interest rates.

6. Consumer Right of Revocation (Statutory Notice)

  • Consumers are entitled to revoke a loan brokerage contract concluded with CommerzCrediet within 14 days without stating reasons, in text form (e.g. letter or email to datenschutz@commerzcrediet.de).
  • The withdrawal period commences upon receipt of this notice in text form. Timely dispatch of the revocation is sufficient to comply with the deadline.
  • Consequences of revocation: In the event of an effective withdrawal, mutual obligations are cancelled. Since CommerzCrediet charges no fees to the consumer, no costs arise for the borrower from the withdrawal.

7. Representative Worked Example (§ 17 PAngV)

All monthly repayment calculations and interest rates displayed on this platform are non-binding illustrative examples.

Authoritative terms are exclusively those specified in the individualized, binding offer issued by the lending bank.

8. Limitation of Liability

CommerzCrediet is liable without limitation for damages arising from injury to life, body or health and for deliberate or grossly negligent misconduct.

In cases of slight negligence in breaching essential contractual duties (cardinal duties), liability is limited to foreseeable, typical damages. CommerzCrediet does not guarantee the accuracy of data transmitted by partner banks.

9. Governing Law and Severability

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If any provision of these terms is deemed invalid, the validity of the remaining clauses remains unaffected.
